Ticket inspection and additional payments

Warsaw Commuter Railway Ltd (WKD) kindly advises that on behalf of the company, the staff of “REWIZOR” is authorised to conduct inspection of tickets on the service lines of the Warsaw Commuter Railway (WKD). 
Transport Law (Journal of Laws from 2000 no 50 item 601 with subsequent amendments) states that:

1. The train service provider or an authorised person, holding a visible identification card, may carry out inspection of the documents connected with the transport of people or luggage.
2. The Identification card as referred to in Paragraph 1 should contain at least the following information:
   1. name of the train service provider,
   2. the identification number of the person carrying out inspection of the documents or luggage,
   3. an inspector’s photograph,
   4. authorisation,
   5. validity period,
   6. stamp and signature of the drawer (a train service provider)....

Furthermore, a traveller has the right to address “REWIZOR” inspector and ask to show the identification card authorising to conduct the inspection.
In case a passenger travels without a valid ticket or a documentary proof for a discount/allowance, an inspector issued the default notice - a statement indicating the payment due for the ride and the additional payment for the ride without a valid ticket.
In addition, “REWIZOR” staff are authorised to:

• ask a traveller to show the document confirming identity, and, in case of a refusal to do so
• ask the Police officers and other authorities to check the identity of a traveller (in case it is impossible to check identity of a traveller).

ADDITIONAL PAYMENTS

Additional payments result from the Regulation of the Minister of Infrastructure of 20 January 2005 on the manner of adjusting the amount of additional payments for the transport of people, luggage and animals as well as the amount of the handling charges. (Journal of Laws no 14 item 117).

1. A person authorised by the train service provider – issues the default notice indicating the payment due for the train service and additional payment in the case of:
   1. lack of a valid ticket or travelcard,
   2. lack of valid documentary proof for the entitlements to free ride or to a discount,
2. An additional payment amounts to:
   1. PLN 180.00 – for the ride without a valid ticket or travelcard,
   2. PLN 144.00 – for the ride without a valid documentary proof for the entitlements to free ride or a commercial discount/statutory allowance,
   3. PLN 72.00 – for breach of the regulations governing the transport of items and animals, including but not limited to the transport of:
      1. items or animals, for the transport of which some additional payments are required - in the case of the lack of a valid ticket or travelcard for the transport of items or animals,
      2. items that are forbidden or allowed to be transported on special terms and conditions - in the case of the failure to comply with such terms and conditions,
3. In the case of due payment of the additional fee within 7 days from the date of issue of the default notice, the amount of the additional fee is reduced by:
   1. 60% of the amount indicated in Paragraph 2 (1) - the payment amounts to PLN 72.00
   2. 60% of the amount indicated in Paragraph 2 (2) - the payment amounts to PLN 72.00
   3. 60% of the amount indicated in Paragraph 2 (3) - the payment amounts to PLN 36.00
4. In the case of due payment of the additional fee within 30 days from the date of issue of the default notice, the amount of the additional fee is reduced by:
   1. 40% of the amount indicated in Paragraph 2 (1) - the payment amounts to PLN 108.00,
   2. 25 % of the amount indicated in Paragraph 2 (2)- the payment amounts to PLN 108.00,
   3. 25% of the amount indicated in Paragraph 2 (3) - the payment amounts to PLN 54.00.
5. The additional fee for causing the unfounded stopping of the train or changing the travel route amounts to PLN 540.00.
6. A handling fee covering the costs incurred by the train service provider in connection with the default of a traveller - during the inspection:
   1. the lack of valid documentary proof for the entitlements to free ride or a statutory allowance /discount
   2. the lack of a valid personal period travelcard and documentary proof for this entitlement after the ride – PLN 10
